But really, IMO we'll just have to do as you suggest and wait and see, and hope like heck that Judge Ward sees it OUR WAY. I'm also hoping he rules very soon after getting the defendants input on Tuesday. I suspect he's already made up his mind, as this issue has actually been around for a while, and I think the arguments on both sides are pretty much as they were before (open to correction here). So unless the next input from the defendants has something truly "profound" and viable, recognizing the urgency for an expedited ruling (presumeably towards settlements), he should move fast. But who KNOWS? (not me!).
