From quickly reading all 87 pages, it would appear that TPL didn't quite convey the meaning Moore would have ascribed at the Markman. Moore seeks to correct this, where necessary, in the "Applicant Arguments/Remarks made in an Amendment" document.
I am not an engineer so I make no comments as to the technical aspects, however, after reading the joint TPL/Moore deconstruction of the USPTO reexamination, I am confident that if granted, the '584(including amendments)will be a much stronger patent than previously. ARM's intervention might be a blessing in disguise simply because of Moore's clarification of salient points, which were absent the original claim construction.
I hope that ARM have had the opportunity to read the document and now appreciate more fully the beauty of the phrase, "dismissed without prejudice".
