With equal due respect, the stipulated judgment on the '584 was without prejudice, that means the '584 can be litigated again, with the J3/ARM as defendants.

The stipulated judgment only removed the '584 from the current litigation, not forever. Also, TPL are appealing the '584 claim construction, as you have posted.
