I have lost track in regard to the sequence of events and quotes from either TPL or Ptsc as they relate to new signings. At the beginning of the year, we heard from TPL, announcing that they were going to focus on the automotive sector this year. We learned of new hirings on Alliacense staff to handle the workload.Then we heard the "dozens" quote referring to the many that sounded close to signing. Later on in the year, we were informed that negotiations with multiple companies were progressing and the pace was accelerating. The court case was always there and the Markman decision strongly favored the Plaintiffs. My question is.....What along the way has caused signings to virtually disappear aside from a few nuisance payments from fairly insignificant players? I am just curious what people think. Was it the USPTO involvement combined with Higgins/ Shaw that seemingly opened the door for renewed invalidity contentions that other licencees were not able to uncover. Was it negative press re. patent trolls etc. and perhaps a perceived notion that attitudes were changing? For myself, I think it was or is the governments attempt to revamp the patent system. Now, accused infringers( I know "roster candidates") are reluctant to sign because the courts and juries are going to give the J3 are fair shake now. My point is....we are getting close to the end and the threat of significantly increasing license fees has not produced new signings. All these things along with the pacer info has put a freeze on closings for now. These are more serious issues than I had first thought. Thus the long review by JW. I sure hope he gives us leg up soon .
