Toshiba Patent Infringement Litigation
On
November 13, 2003, Toshiba Corporation filed suit in the United States District Court in Delaware against
the Company, alleging that certain of
the Company’s products infringed several Toshiba patents, and seeking an injunction and unspecified damages. A Markman hearing was held in April 2006, and a ruling favorable to
the Company was issued on
June 28, 2006. Based on the ruling, Toshiba stipulated to non-infringement of the asserted patents and subsequently appealed the ruling to the United States Court of Appeals for the Federal Circuit. The appeal was heard by the Court of Appeals on
July 11, 2007.
