Defendants have used all possible defenses (as they should have)and in light of KSR, if they are settling as I believe they are, after everything they have thrown at the wall, Big Dollars now will be better  than a Trial in that, we won't have to go through the ordeal of appeal.

Remember, they are looking at every widget that has infringed back to 1989 and then the defendants still have to sign a license for future use of the MMP until 2015!
