Bear in mind that not only the Defendants, but their insurer(s) would be concerned and would require a transfer of the risk back to  Insured in an attempt to limit their own exposure of paying full policy limits at trial, (assuming of course the Insured Defendants carry some form of Patent Infringement liability CAT limits above a high Self Insured Retention/deductible).

 Also I'm curious if Phillips paid the initial $22M requested by Alliance.
