I recall very vividly that Despains ( sp ? ) argument emphatically denied it 'had' to be 'right justified' only.
He went in to great detail on the subject. I also recall the Markman giving us a black eye on that very point and I wondered how that could be when Despains case was so well proved. Perhaps his point was not allowed to be introduced at the Markman. ( Expert witness was not allowed )
Anytime a court gets involved one never knows the outcome. I'm glad the subject came up again because I thought the logic of Despains was flawless. Hopefully so shall the USPTO.
