You would think that settlement should happen because of court dates that have to maintained because of the xmas holidays coming up and the courts (JW) would have to move most everything well into next year.

JW won't be moving anything... the trial date is set.. the parties either settle or begin preparing for Jan 8 trial..

As I posted previously, the parties may request additional Stay time inorder to realize settlement.. J Ward would not neccessarily grant it, but knowing how pressed all would be for time re trial, probably would knowing settlement was iminent.
