The Judge can only rule on matters brought before him. The MMP Portfolio was not in the litigation and is therefore outwith his remit.

As I tried to explain, the Judge needn't even be informed of the settlement terms, just a joint motion to dismiss.

I see this Judge as packaging all loose ends and making the decision/settlement final. As in, I will not see or hear of you guys again!

As far as the Judge is concerned, the only loose ends are infringement of the '148 and '336 patents. Once the '584 Appeal has been resolved, the Judge will no doubt see TPL/PTSC again.
