you are correct as I remember posting this from the last section of proposed bill on i-hub some time ago.

 

Also, EHWEST also seems to be under the impression that government agencies (such as USPTO) are the "final word", when in fact, everyone should know that the judicial branches of government frequently (sometimes too frequently!) reinterprets laws of this country and thereby are the final word....
