If indeed this means the '336 has just now been assigned to an examiner.. it is possible that settlement, short of MSJ, has in fact been realized, and TPL has informed the USPTO (as per I believe is their responsibility) that no formal court ruling will be made on the '336 and they can now proceed with the '336 reexam..
