You are definitely correct on me repeating myself. I suppose I had received no affirmation or negation and wanted to hear what you and others felt about my conjecture.
I believe J3 won't cave in until PTO makes a decision. They are looking for any possibility not to pay up and will continue to fight as long as there is hope of a reversal of the Markman decision.
I do not think a Summary Judgement will be requested by TPL at this time. Trial is only a little over a month away. Opty, I don't have the legal background to determine if SJ would provide the comprehensive judgement that us, the Plaintiffs want and am glad to listen to the rationale for its use.Why do you think an SJ will occur at this point?
I believe that TPL and PTSC want this settled once and for all with a precedent type announcement. PTO is a thorn in our side that will finally be determined within the next 3 weeks.
I hope that a Pacer today may clarify what is going to transpire as far as East TX is concerned and that may have some bearing on the overall picture.
