While I can agree with your logic, IMO the Js already got a real big hint via the Markman. Then throw in the supposed/probable denial on the ACP defense - huge clue.
It's fun to think of what the Js may be thinking these days. Fujitsu got out for some $30M, and they could wind up paying 5-10 times that amount - just for being stubborn, all the time knowing that hey, it's Judge Ward, in the EDoT! LOL And we think we're enduring..... LOL
I envision the sealed submittal as a probable "complain and moan". Gosh Judge, we really did try to settle, but these guys are demanding way too much money, even though we profited by billions of dollars every year by stealing their tech. Sympathy? LOL
