This all is conjecture on my part. It is to everyones advantage to have PTO behind them. PTO must prove that their analysis is fair and based on fact. Thus, TPL's pleasure with the complete thorough analysis of Judge Ward. The question remains if PTO is up to the task? This is a concern I'm sure for TPL. At the same time, signing after signing, Markman victory and accomodations by TPL are extreme positives. Nothing but positive occurances since back in May!

Things would be a lot smoother if PTO made their decision first and then the Court decision could take this into consideration. PTO doesn't live in a bubble. They know what is going on. Examination is an extremely time consuming effort. I am not sure if PTO is paying overtime. Exactly how this will play out is up for grabs.

I know J3 is stalling. This passes the obviousness test. PTO may be waiting until the trial (or possibly SJ) is over or maybe not. No one is talking. PTO says we are working hard on it. This may not occur in the timeframe that the POC stated. This is political, economic, psychological and judicial quagmire that tests the competence of all involved.

If prior art cannot be proven, it will be a glorious day for the MMP.
