Judge Ward ruled differently it could be very embarasing if the appeals court upheld the lower court ruling. The patent office would have a very light shined on their processes that I don't think they want. I will, for that reason, be surprised if we get a PTO ruling before the court action is completed. I have no idea what I am talking about. Just expressing an opinion for discussion.
