Then why have a trial?

Presumed innocent until proven guilty.

 

 

Cetainly you can't tell me that every time a Markman goes in favor of the plaintiff that that proves infringement?

It is one piece of evidence that the Plaintiff will use to further substantiate their claim of guilt, not only against the current Defendant(s) but also potential defendants. Didn't Daewoo settle recently?
