Bill, I'm not sure a rejection would be bad news, as I think our side is holding most of the cards here.  While I'm in the camp favoring a good settlement, I wouldn't be upset to see this go to trial (or at least to J caving on the courthouse steps).   Anything can happen at trial, though.
