I often wondered how the current litigation and invalidation would affect each other, however I don't think we will be invalidated (MO) But since the expense of trial is so substancial then a lot would depend on the current stage of re-examination.The likely hood of a stay for re-exam, considering the evidence you presented, seems less likely but all cases are unique. Invalidation would seem, to me anyway, the only hope the J's have and that is why I, for one, concluded the possibility of a stay for re-exam. We shall see. Great work
