This doesn't make sense to me, considering that the possibility of 3 times damages and statements like the following;

"We are confident we will prevail." He confirmed that TPL is pursuing damages for past infringement, penalties for willfulness, and an injunction prohibiting further operations in the US."
So what do you think would happen to Matsushita or Toshiba if there was an injunction to cease selling infringing products?
If this goes to trial, don't you think that TPL/TTC would take the gloves off.
What do you think JW court room would be like after the J's pissed him off.
Correct me if I am wrong; but as recent as today our resident Lawyer believes things are on tract for settlement (my words).
