Mabye they are in such a strong position (no invalidity motion by the defendants, no negative USPTO ruling against the 336' and 148' patents, Markman Ruling positive, and mabye the ACP issue was also in our favour, what we don't know), that they decided not to file for MSJ, because a MSJ ruling can be appealed. Why should they take this theoretical risk, when they anticipate a settlement, that can not be appealed?I hope nothing more than for you to be correct.. But if TPL is in such a position of strength, why would there be any threat of appeal.. what could the Js hope would come out of the woodwork for them to have any chance of successful appeal?
Again. I hope this is all moot this coming week...
