Must have missed my question from last nite.. it was late..

Since you believe the Js must have no case on invalidity at all, due to the fact they did not file a MSJ against TPL..

I humbly suggest that were there any weight [KSR], the Defendants would have filed a MSJ long before now

..why then do you think TPL never filed their/our own MSJ.. given our position of strength after the Markman (and the '584 having been subsequently removed form this litigation) ???
