FWIW..The only comparison I can come up without performing a lot of DD tonight is the Echostar vs. TiVo case. TiVo won their case against TiVo in April, 2006 in the Texas venue. Echostar immediately appealed the case, and I believe the Judge heard first oral arguments for the appeal October, 2007 (18 months into process). This example is for a case that went to trial and the verdict was appealed, so I am not sure if this process would happen quicker or take longer than the appeal of a Markman rulling?
