"Mr. Giffhorn has demanded damages of approximately $4,500,000 (excluding claims for punitive damages and attorneys fees). The Company denies the allegations and believes the claims to be frivolous and totally devoid of merit. The Company has retained litigation counsel and intends to vigorously defend the claims"
"On November 1, 2007, the Company and Mr. Giffhorn reached a settlement where Mr. Giffhorn was given $500,000 and 200,000 shares of restricted Company stock in exchange for a comprehensive release of all claims against the Company"
So much for the tough talk in the previous 10Q's. If our board really thought this lawsuit was bogus why the pay out? They intended to "vigorously defend the claims"...what happened to the vigor? These guys are too much...lol! Too lazy to even defend thier own cookie jar!
