It's a bit like your financial brokers brochure including the statement,

"the chart depicted is an accumulation of past events and in no way represents or implies future guarantee on returns."

The resolution between the existing parties doesn't guarantee they won't run into legal hurdles down the road with other potential infringers. They have to include some kind of disclaimer.
