I guess I am just having a difficult time seeing how a contingency clause would defeat a settlement. I pay you X now and Y later and you agree......how does that defeat settlement?

Not sure about he article that BaNosser referenced. Why wouldn't TPL and Patriot come right out and say in their own PRs that the Js licensed 7 patents? Or did they? Please provide me with the link to that article if possible.
