Before the numbers of the 10Q come in, I wanted to point out, that the critizised "nuisance fees" of 2006 and 2007 follow a simple mathematic scheme:
If TPL/PTSC has two companies in its focus to buy a license BEFORE or AFTER Markman/Trial/End of 2007/whatever...
- company A one million BEFORE, AFTER doubled = two millions
- company B ten million BEFORE, AFTER doubled = twenty millions.
With which one would you negotiate FIRST...? If company A"wants" to wait, TPL/PTSC only get one million more, but if company B decides to wait, it's a ten-million-difference.
If I was TPL/PTSC in 2006 and 2007, I wouldn't focus the powers of my employees on the big names (only if it was important for the litigation), but on the little fish. They help me increasing the number of licensees (validity in the market) and cover my operational costs.
In 2008 the picture should be different (as far we can rely on TPL/PTSC statement of increasing licensing fees...what I do).
