As for Philips, while TPL apparently asked for $22M, I'd expect that was a high target, with them expecting to negotiate down from that. So if Philips indeed signed for less, as long as it's not substantially less, I think the fact that they wanted to get it done BEFORE trial/settlement does support TPL/PTSC having a position of strength. I'd say $15M or more would confirm that IMO, and $10M or less would really make me question whether or not we are really settling for "nuisance fees". But I certainly wouldn't doubt that TPL/PTSC could have used a fee less than the $22M to entice Philips to sign rather than chance post trial/settlement fees at a higher rate. As long as they didn't give away the farm, I think Philips agreeing to MILLIONS, as long as they're near the $22M, still shows strength, or perhaps more properly stated, doesn't show weakness from TPL/PTSC.
