From the prospective of the "battle" the only question that needs to be answered is wether there was a net gain, net loss or no change in the balance of power.

While the second was decisive and led to a capitualtion by the French, the 1st was not and was merely a part of Navarres overall strategy that eventually backfired.
Back to Texas and the battle in the J3 Corral. I would be a proponent that regardless of the net dollars received from the J3, the battle was a "first strike" and therefore a defensive maneuver. That PTSC/TPL do not have court battles as part of their strategy and that the outcome ( that ignoring dollars TPL maintains its patents ) shifted the balance of power between TPL/PTSC and the 385 remaining infringers more toward PTSC/TPL than away and is therefore a favorable outcome.
While other large players might consider fighting this out in court, reviewing the 2 year struggle that eventually ended in a license should be a strong enough deterrent.
