Thank for contacting me regarding the Patent Reform Act of 2007. I
appreciate you sharing your concerns with me.
On April 18, 2007, Representative Howard Berman (D-CA) introduced
the Patent Reform Act of 2007 (H.R. 1908) to bring about important
reforms to the United States' patent system. While ensuring that the
United States will remain a world leader in innovation, it provides
important modifications to existing law to ensure that higher quality
patents are being issued and to reduce baseless lawsuits.
H.R. 1908 changes the system by which patents are award from the
United State's unique "first to invent" system to a "first to file" system,
which harmonizes American patent law with the standards of other
industrialized nations. H.R. 1908 also seeks to reduce the issuance of
low quality patents. The issuance of poor quality patents has a harmful
effect on innovation by leaving other potential patent seekers unsure if
their product will be in conflict, often resulting in long and costly
litigation or a reluctance to pursue new and legitimate patents. This
legislation also establishes a post-grant review process, which allows
challenges against recently issued patents, and puts rules in place to
prevent harassment or abuse. Finally, H.R. 1908 addresses the rise in
excessive damage awards in some patent infringement cases by
recalculating the way damages are considered.
On September 7th, the House passed H.R. 1908 by a vote of 220-175, and
it has been referred to the Senate for further consideration. I supported
this legislation, which I believe will strengthen the ability of American
inventors to file legitimate patents, and will reduce needless lawsuits and
excessive damage awards. Please rest assured that I will work diligently
to ensure that the United States remains the world leader in technology
innovations.
