Are you saying this preempts our ability to now proceed directly to seeking injunctive relief?  Just a lawerly question to which I do not know the answer .............. but if the 'new J-boys' want to play games in court perhaps we proceed right to the jugular and seek to disrupt their supply chain, if warranted, and if it does not negatively impact negotiations with others etc...
