First, you assume that PTSC is/was aware. You don't know this absolutely. Perhaps TPL was withholding to evaluate before advising.
Second, what is this suit about? Are DAMAGES involved, at all? Or is this new opposition merely seeking the court's assistance in resolving a dispute - which has existed with them for a supposed 14 months, and also exists with some 450 other companies? Does this rise to any real level of significance, in the grand scheme of things?
Now, I'll admit that I may be all wet because I haven't read everything available today due to unusual time constraints (bad day for my cat - "Dude" - he got fixed today. Does that mean I have to change his name to "It"? LOL). And of course this also means that my lengthy conjecture may be all wet as well. Hey, I worked with what I had!
It seems your finger is always on the trigger to jump on our management, while IMO you're operating largely in ignorance as to what is really going on - and on things that IMO should not be disclosed.
Now, how old is that/those filing(s)? I read ten days, a week, and four days. Which is it? And remember we just had a three-day weekend. Do you think it's reasonable to at least allow the lawyers to have a close look at this before prompting PTSC to push the PR button? And maybe help craft that PR? Jeepers.
JMHOs and questions,
