San Diego-based Qualcomm contends that Nokia's assertion about "what are
fair and reasonable rates for Qualcomm's patents are directly contradicted by
its demands for its own patents." According to Qualcomm:
Nokia demands 2.5 percent for a single essential patent,
3.5 percent for two,
three patents run 4 percent
and 10 or more will go for 5 percent or higher.

IAs I've said in the past, if I had hired Roger Cook, I would expect him to negotiate
what I was entitled to by law during the J3 settlement proceedings.
If the J3 had NOTHING to take to a Jury and Roger Cook knew it, wouldn't
he demand what PTSC/TPL were entitled to by Law?
What would the J3 say at that point............NO? Where could they go?
To a Jury? With what? ACP upheld! Markman on 336 and 148 belongs
to PTSC/TPL........clear winniers. And maybe face Triple Damages??
I think we're all going to be pleasently surprised by
the settlement. This is my opinion, but from all the DD we ALL have done
for "years" now.............we all wonder what Roger Cook is all about,
don't we? April 9th will tell us.
Again a question for the more knowledgeable:
I understand what the 336 does and how it has literally changed the
way ALL THINGS DIGITAL operate today. It's the core technology in
ALL THINGS DIGITAL opeating at over 120 mhz Today and as we all
know that's pretty much everything from computer chips, , to Cars, to
Games, toys like Dancing Elmo lol, to Appliances, handhelds, set top boxes,
tv's.............electronics........... printers, etc.etc. Think Digital!
We also know that this is a hardware process that is responsible for basically
speeding up computers. Anyone that worked with computers prior to 1989
will remember how slow and difficult they were to use (for Me anyway)
just look at the names of all 44 License holders over the past 2 years.
Many many Major Billion Dollar Corps.
So, what Royalty Rate would a Core technology like the 336 patent be
able to command?
If Nokia demands 2.5% for a Single Patent and 3.5% for Two, why can't we?
That's the very question Qualcomm asked above.
Early Bird specials like Fujitsu got two years ago are gone IMO........ (32 Million).
If Roger Cook was in the drivers seat as many of us believe he was,
he should have negotiated a fair and reasonable past infringement
rate as well as a Future Royalty Rate for his clients PTSC/TPL. Isn't that
what we hired him to do? Remember what Roger said when he first came
to understand what our Patents had done to the world of Digital comptuers?
The MMP portfolio is a Patent Litegators Dream. Why, cause it's in
everything digital. RIMM, Apple, IBM, Samsung, Dell, Motorola, Microsoft,
BMW, Mercedes Benz, etc.etc.
Whether they paid in a lump sum or it's going to be spread out until 2015 doesn't
matter. What matters is showing the World what the MMP is truly worth.
Apparently the T3 can't believe that little David could really kick Azz on Big
Goliath. They admitted to negotiating with us for 18 months and now they
are charging us with what?
Wanting them to pay Usual and Customary License fees for using our Property
for Free for HOW MANY past years and/or future years?
Well hopefully after they get to See the numbers on April 9th along with the
rest of us, the T3 will finally "understand" what the MMP is truly worth.
We got within 2 and a half weeks to a Jury Trial and the J3 settled. The T3 will
soon have proof as to what rates the MMP can command.
Should be pretty interesting on April 9th. And I hope very revealing for all of
us. I'd like confirmation that at least Some of the dots we've been connecting
were right.
