To me you've hit on an excellent point. After speaking with my almost Bro-Law this weekend this whole ARS issue really opened my eyes. I didn't realize how serious it was and all the individuals and companies potentially impacted by it. Perhaps FutTheW can clarify on the issue. Can Patriot still borrow against its cash tied up in an ARS? If they found themselves needing to work a deal, could they use this capital as collateral? UBS told my Bro-Laws father it would be 1 year before he could get his money.
My father-in-law warned me against companies that don't reveal much information and place the blame solely on an NDA. His company signs multiple NDA's a quarter and most are with very well know electronics companies. I asked him how they work around the NDA and he said it's simple, you meet an agreed upon terminology and go from there. He said neither you or the company signing can prevent the shareholders from having information the could have a material affect on their investment. However, he did say that it's been his experience that a Federal Judge is almost more powerful than the SEC. When your in the court of law and it's a Federal Judge their as close to God as you can get. Hopefully whatever agreement Judge Ward is over seeing will reveal itself soon. I just can't get on board that this is all there is to it. The MM's are going to have a field day tomorrow. I think I'll take 2 pair of underwear to work........
