The patents are in the process of being revalidated or invalidated. You know this, Bill. I believe our attornies believe we would have been at significant risk with a jury if the patents were reviewed in court, even with a favorable Markman hearing, to decide against PTSC/TPL. You may be correct that the jury had to use the Markman although, I thought that was Judge Ward's opinion, certainly a major victory but not final victory in a jury trial.

I did speak with USPTO. I was told by the person working on 584? that the 3 would be decided within a short timeframe. Evidently, they were wrong. I still passed on this message, regretably. Obviously, I was incorrect based on this information.
