<These options vest upon Mr. Goerner's conversion to permanent CEO and the occurrence of any of the following: (a) A successful M & A acquisition brought forth by Mr. Goerner, (a merger or acquisition with TPL excluded), approved by the board of directors,>

Now that the qtrly is out and there is an indication that perhaps cash is not part of, or a small part of the settlement, I restate my March 3, 2008 post. In lignt of the exclusion above, perhaps an acquistion with TPL is not so far fetched. When reviewing the information contained in the link pay particular attention to the ownership and notice that Toshiba goes from 15% to none on March 31st. Perhaps, waiting for Hitachi to license before any announcement? Opty

<The Texas court settlement brought two separate settlement pacers. The one for NEC America is clear cut. But the one for Matsushita and Toshiba contains a Memorandum of Understanding and the court will insure that settlement terms are adhered to. IMHO this does sound like some sort of a deal beyond cash.

Just so happens that Matsushita and Toshiba are JV partners in a company called IPS Alpha, which is expanding LCD production and talking of possibly OLED to counter Sony. What's the possibility? Here is info on IPS Alpha. Opty>
