Folks, as promised, I asked a patent attorney about the possibility of on going royalties for the J's or potential license fee contingent on favorable USPTO reexam. See his response below.
"A settlement for ongoing royalties is a possibility. It is also
possible that royalty payments only continue so long as the patent is valid. It is less likely that a payment kicks in if if the Reexam comes back in our favor. Sorry I can't give
more direction, but it's tough to predict what may have happened."
I am not advocating that he is correct, or incorrect, as I honestly do not know, and am only sharing his response with you because I promised last week that I would. At this point in the game I am as dumbfounded as most of you by what transpired this past week. I have many opinions, but they are just that, my opinions with no fact.
