I've also mentioned before "why grant a license if the patents are not infringed upon".To me, when also considering the markman hearing ruling, that only leaves validity as an issue. I think I would rather have the USPTO determine that than Judge Ward. No input from the other side, other than the original filings, no appeal if we win, two appeals if we loose. Too good of an advantage to give up. So, it all makes sense to me. Some feel that we gave up 100 to 200 million payment from the J's and no more money is coming. I can't see our undrugged lawyers doing that. There is absolutely no reason for that ocurrance. We were in the drivers seat. Now this thing is settled, with no more appeals. We did give up something for that but not 100's of millions. No way.
