SGE - Please forgive me but I'm getting cornfused. You said "so elements of NEC and Toshiba were "counter claimants"... hence their "without prejudice". Please decipher... I must be getting old (and you've been here a looooooooong time too!). Why were they dismissed without prejudice when others were dismissed "with" prejudice? What do you mean by "counter claimants" in this instance, and why would that affect the circumstances of their dismissal?
