I have to go back to the News releases leading up to the settlement and they would indicate that there is more coming.
-June 18, 2007 The TPL Group and PTSC today applaud the Markman ruling which broadly confirmed the strength of the MMP portfolio.
According to Dan Leckrone, The ruling overwelmingly confirms MMP Portfolio by definitively establishing and clarifying the meaning to assigned claims against Matsushita, Panasonic, JVC, Toshiba, and NEC entities.
-June 28, 2007 The stipulation to dismiss the Toshiba ASIC's devices. In light of the sweeping scope of infringement of the MMP Portfolio by Toshiba systems products. According to Dan Leckrone, This was simply an effort to streamline the infringement trial by sharpening the focus on the expansive category of infringing system products manufactured and sold by Toshiba and other defendants.
-July 24, 2007 Motion to reschedule the trial. Dan Leckrone said "we have come to realize along with the defendants that there is a need for the additional discovery time because of the extremely broad scope and pervasiveness of infringing end user products".
-August 8, 2007 Motion to Remove ARM as a defendant and the 584. Dan Leckrone said "We are confident we will prevail." He confirmed that TPL is pursuing damages for past infringement,penalties for willfulness, and an injunctionprohibiting further operations in the US.
-September 13, 2007 TPL wins Approval of motion to remove ARM and the 584 from the trial in Texas. The trial will focus on the 336 and 148 both of which encompass several claims against accused products manufactured by defendants.
-September 27, 2007 Appeal to reverse US 584 patent in MMP Markman claim construction. Dan Leckrone said "We believe the June 18th Markman ruling overwelmingly supports MMp Portfolio claims against Matsushita, Panasonic, JVC, Toshiba, and NEC entities". The infringement trial will focus on the 336 and 148 Patents. TPL Asserts that the Markman ruling broadly confirmed the strength of MMP claims including the ery significant affirmation of the 336 as applied to both modernPLL-based and non PLL-based systems.
Leckrone warned that all maufacturers of end user products using infirnging ARM processors with the exception of the 20 global manufacturers who have already purchased MMP portfolio licenses - are infringers of technology protected by the MMP Portfolio. "The longer infringers wait to purchase an MMP license, the more they can expect to pay because our program is to reward first movers in various industry categories".
Now I ask did TPL let these guys off the hook? I don't think so!
