Would it have been better for TPL to have the patents re-emamed first?

I know we have collect a lot of money to date. And i am sure TPL figured sooner or later the patents would get challanged. So if we would have had them validated again. We could have elemenated all this early mover stuff. A few things I fall back to, TPL stated that all the liceeeeee tried to claim prior art and all quickly found out it was not a good defense. TPL also stated that a key part was missing in the total marksman ruling. part 29 of 584. also the pto exames were ex-parte we got the chance to but the best spin possible on our patents with one of the most creitable people IMHO Mr. MOORE getting to defend his patents. I hope it is enough. when you read the arguments posted it seems like a no brainer but who know.
