Think about this;
Judge Ward is holding an agreement between the J's and TPL/PTSC for a reason. If the settlement was done and PTSC was not getting anything more, then there would be no reason for Judge Ward to keep holding the agreement.
Many here feel the USPTO decision is about the only thing the J's had to bargain with in the negotiations and the settlement deal that Judge Ward is still holding is pending the outcome of the USPTO ruling on the patents.
Really when it comes right down to it isn't it all about the USPTO review at this time. If the patents are re-validated the settlement dollars are paid by the J's and everyone else and we get rich.
If the patents are invalidated game over no settlement dollars from the J's or anyone else for that matter and we have to work a little longer before we can retire.
IMO the latter is very unlikely in light of the fact that the review is exparte and TPL can appeal the USPTO decisions twice to defend the patents.
All the best,
Steve
