I agree with you. I have not problem with Brian being critical of PTSC, when those criticisms are accurate (and I believe they have been). Also, just because he was the shareholder rep to the advisory board, I don't think he should be limited or prohibited from criticising or even strongly criticizing the company or the BOD. The key term, afterall, is "SHAREHOLDER", which he is, just like the rest of us, so I think he has the same rights and responsibilities that we do.
That being said, I do think Brian has a responsibility to realize that HIS words/posts would/will be taken with extra importance, due to his position, and with that in mind, he should be very careful about the timing and content of his posts. I'm not saying that I think he did anything incorrectly on either account, as from my perspective he didn't. But others obviously disagree. With that in mind, he shouldn't hesitate to go the extra mile (especially now that he has resigned) in explaining his positions clearly, and as completey as he can, as there has obviously been some misunderstandings and miscommunications. If we all become too proud or insulted to share our opinions and DD, then there would be no value to the board, and we would be hurting even the people we respect, along with those who have caused us that insult.
Furthermore, just because someone has lobbied out there that he's NOT a lawyer, doesn't make it so. One unfounded sniper like post to that effect has many people questioning whether he is or not. While I take PTSC's PR as fact (as I have to hold Pohl & the BOD responsible for having vetted the PR and Brian's credentials), it would do NO harm for Brian to address others' concerns about this.
From my perspective, I would like to have Brian's insights as to the issues he raised, like the impact having much of PTSC's cash tied up in illiquid assets at a time where they've professed they are trying to complete an M&A process. How can they do so with illiquid resources, OTHER than further diluting our shares which are already extremely diluted at 391M shares.
Also, I'd lke to hear Brian's perspective on the BOD make up and where, based on his interaction with them, he sees value and weakness.
I have seriousl concerns about PTSC's willingess or ability to effect and govern TPL/Alliacense in their billings to PDS, their licensing efforts and structure, and the prevention of conflicts of interest with TPL's other IP licensing efforts and business endeavors. Greeneyes raised the PDS BOD make up issue, which highlights my concerns. While his position may or may not have afforded him any more insight in to the arrangement than any of us have, I would like to hear his perspective on this issue.
Even with this being said, Brian is just another shareholder and poster on Agoracom. I respect his opinion and value his input. However, I do not trade or make decisions based on either of those. I simply use his, like I do yours and others' input to augment my own DD, and from there I make MY OWN choices to buy/sell, etc. I hope others look at my posts similarly as I am only providing my opinions based on the best information I can find and make educated conclusions on.
