If I recall that theory was discussed in several motions concerning translaters, document size limits for discovery, and etc. Arm was even complaining about the amount of documents it provided TPL that it didn't even use.(was it 14 million pages ?) I don't think we were prepared to submitt the vast amount of discovery in the amount of time provided by the rocket docket.
