LOL! So Brian pointed out the obvious? LOL! BTW, it wouldn't really be "getting around the courts' decision", IMO. It is what it is and nothing is going to change that. The court was looking at the '584 "as it was". There is no "getting around" that. I do recognize that you may have been paraphrasing what Brian had to say, so no overt "ding" on Brian, except to say, in the context of the below, it is "obvious".
The '584 will come out of the re-exam as something a bit different.
The patent claim "rebuild" on the '584 via the PTO re-exam will be a "renewing" of the patent. With the "renewed", amended patent in hand, we will hopefully have the ammunition to pursue those who solely infringe the '584 (if there are such animals, who don't concurrently infringe other elemenets of the MMP).
