If you have three patents that are essential to production of high speed chips, and one or even two of those patents get shot down, have you really lost anything?

If you were being held for ransom, refuse to pay, and have three guns pointed at your head, but it turns out that two of those guns aren't loaded, but the third one is, should you pay? Should you pay less?

IMO, the vulnerability is unchanged, and the value is unchanged.
