I think what Mark is trying to say ,and I believe he is correct, if the PTO and the courts come up with oppisite rulings it make the syatem look broken... In fact PTO now use court rulings as reference...ie Markman ruling..... I think if thier was difference IMHO they delay and try discover why.... IMHO this search is just part of what the PTO must do... we will know in a week or two...
