The warning you see on the Fitjitsu site was workable for TPL before the Quanta case, when the courts were willing to honor that type of situation with the right for a patent holder to collect infringement. The supreme court changed it around.

I was under the impression that the SC found there was essentially NO Conditional language in the contract b/t LG & Quanta... thereby making the contract UNconditional.. ?

I believe this language by Fujitsu makes PTSC/TPL contract Conditional...

Now IF this type of language was properly in the LG/Qunta contact then there would/may be reason for concern...
