A patent can get an extension if the issuance of the patent was delayed by the BPAI or through the courts to determine its validity. It also can get an extension if there was a court ruling overriding a previous determination of invalidity....we had a determination of extension on our 148 patent..through a request and review by the PTO ...none was granted.
