"The likelihood of the USPTO reexams being over by the time the NDoT is close to trial is very, very, very good IMO."
Can we afford to chance that?
One more point and then that is all for me. The last trial cost us 13 million in legal fees and what did we get in return? Certainly not enough. We have a new lead council because I would imagine they are 1) either, better, or 2) Cheaper. We can't afford to have happen this time, what happened last time. We all know the license fees have slowed down since the J3 trial. We hopefully have other revenue streams to keep us afloat for a couple years. So why would we want to rush to trial before the re-exam is completed. We have nothing to gain, since they have seen how we played our hand out with the J3. We don't need no stinkin' Rocket Docket. We need to stall, stall. stall.I would hope that TPL learned their lesson from the first hose-bag trial. What were they thinking? We need a lawyer who can talk, and think on his feet, just to be brief (Pun intended) Just writing a good brief is not good enough, not for my 13 mil.
